The full rental amount and the $100 security deposit are due at pickup. The security deposit is not a limitation of liability. Upon return, Trailer Bros LLC will conduct a post-rental inspection within 48 hours. If no damage or additional charges are identified, the deposit will be refunded in full. If total damages or charges exceed the $100 security deposit, renter agrees to pay the full remaining balance immediately.
Renter must be at least 25 years old, possess a valid driver's license, and maintain active auto insurance. Only the person listed in this agreement may tow the trailer unless approved in writing.
Renter assumes full responsibility for all damage to trailer during rental period, including tire damage, brake damage, theft, vandalism, and damage to third parties. Renter's auto insurance shall be primary coverage. Renter agrees to indemnify and hold harmless Trailer Bros LLC from any and all claims, injuries, damages, or losses arising from use of the trailer.
Renter is financially responsible for any and all damage occurring during the rental period, regardless of fault. This includes bent axles, structural damage, gate or hinge damage, tire damage, electrical damage, brake system damage, coupler or jack damage, missing accessories, excessive dirt or debris, and damage caused by overloading or improper towing.
If trailer requires repair, renter agrees to pay the full cost of repair, diminished value, loss of rental income during repair, and an administrative fee of $150. If trailer is deemed a total loss or stolen, renter agrees to pay replacement value of $4,800.
Trailer must be returned reasonably clean, in the same condition as received, and at the agreed return date and time. Failure to return trailer may be treated as theft under Arizona law.
Late fee: $10/hr for any portion of an additional day, capped at $60 per additional day.
Renter is responsible for all roadside service costs unless failure is due to a mechanical defect not caused by misuse.
Renter authorizes Trailer Bros LLC to charge the payment method on file for rental charges, late fees, damage repair costs, administrative fees, loss of rental income, and collection costs. If payment is declined, renter agrees to pay the outstanding balance within five (5) calendar days. Unpaid balances may be sent to collections or pursued through legal action.
If renter breaches this Agreement, Trailer Bros LLC may repossess the trailer without notice, charge the card on file, and pursue legal remedies. Renter agrees to pay attorney fees and court costs if collection is required.
This Agreement shall be governed by the laws of the State of Arizona. Venue shall be in Maricopa County, Arizona.
Renter acknowledges that the trailer has been inspected, that renter understands towing requirements, and that renter assumes all risks during the rental period.
